Below are the answers to some common questions regarding Administrative Review.
What is Administrative Review?
If you believe the caseworker who decided on your visa application made an error you may be able to apply for Administrative Review. Not all UK Visa and Immigration decisions are eligible for Administrative Review, however, our Immigration Law Solicitors can quickly let you know if your particular application qualifies.
What is a case working error that would trigger the right to ask for an Administrative Review?
A case working error is defined in the Immigration Rules as:
Where the original decision maker’s decision…was incorrect’ or ‘where there has been an error in calculating the correct period or conditions of immigration leave either held or to be granted.’
How long do I have to apply for Administrative Review?
If you are outside the UK when making a visa application you must apply for Administrative Review within 28 days of receiving UK Visas and Immigration’s decision. If you are already in the UK and your visa application was rejected, you only have 14 days to apply.
Do I need to provide evidence of a case working error?
Absolutely, and the more evidence you provide the greater your chances of success.
Do I need an Immigration Law Solicitor to apply for an Administrative Review?
No, however, the advantage of instructing us to advise and represent you is that we have the knowledge and experience to understand not only how and why a case working error was committed when your visa application was reviewed, but also our team, through our many dealings with UK Visas and Immigration, appreciate the decision-making process of reviewing caseworkers and can structure your Administrative Review application in a way that is more likely to achieve success. Remember, if your Administrative Review application is rejected, you may not be able to enter or stay in the UK. Your only way forward may be a Human Rights Claim or Judicial Review, which are both expensive and time-consuming options. Investing in getting your Administrative Review application prepared and submitted by our experienced team may save you thousands of pounds in the long run.
