What is the difference between an asylum seeker and a refugee?
The 1951 Refugee Convention defines a refugee as a person who “owing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.”
An asylum seeker is a person seeking international protection from persecution in their home country but has not yet been granted asylum. To successfully gain asylum they must cross the border into their country of destination and prove to authorities that they meet the Refugee Convention definition of a refugee.
Although not all asylum seekers are refugees, all refugees start as asylum seekers.
How do I claim asylum in the UK?
It is not illegal to seek asylum in the UK as it is a signatory to the 1951 Refugee Convention. You must claim asylum as soon as you enter the UK, for example by telling a border official at an airport or seaport or seeking out a police officer when you arrive in the country.
Remember, you must prove that you cannot return to your home country because you have a well-founded fear of persecution. This can be difficult if you have had to flee without time to collect any documents.
