Am I eligible for British Citizenship?

There are several ways to become a British Citizen if you were not born in the UK. The most common route is through naturalisation. To qualify you must:

Do I automatically become naturalised if I marry a British Citizen?

Unfortunately, no. You will normally have had to been in the UK on a Spouse Visa for at least three years before you can apply for naturalisation.

What is meant by ‘good character’?

To meet the ‘good character’ requirement you must have obeyed UK criminal and immigration laws during your time in the UK. If you have been convicted of a crime it does not necessarily mean that you are ineligible for British Citizenship, however, it may be more difficult to obtain.

If you have been convicted of a serious crime and have spent four or more years in prison, your British Citizenship application will be refused. Likewise if you have been found guilty of committing an immigration offence in the previous ten years before making your application , or entered the UK illegally.

If you have served a custodial sentence of between 12 months and four years your citizenship application may be refused unless at least 15 years have passed since you were released from prison.

Our Immigration Law Solicitors can advise you on the impact your criminal convictions may have on your British Citizenship application. We do not judge our clients, the only concern we have is providing you with the legal advice you require to move forward.

How long does it take to process a British Citizenship application?

UK Visas and Immigration are normally able to process applications within six months. However, if you do not submit all the required supporting documents or make a mistake on the application form, it will take considerably longer. One of the advantages of instructing one of our team to assist you with your citizenship application is that we will ensure that every element of your submission is correct.
