How do I make an application to remove my driving disqualification early?
Under the Road Traffic Offenders Act 1988, the Court has the power to remove a driving disqualification before its official end date. Strict criteria must be met and ultimately it is down to the Courts to decide whether early removal is appropriate.
An application to end your driving disqualification early is made to the Magistrates’ or Crown Court that originally disqualified you from driving.
It is possible to make an application to end your driving disqualification early if:
- You have been disqualified for three years and at least two years since the disqualification has passed.
- You have been disqualified between four and ten years and served half the period
- You have served five years in all other cases
Once you have lodged your application with the relevant Court and paid the application fee you will receive notification of the date your case will be heard. You must attend the hearing and provide evidence as to why your licence should be returned. You may find the police are represented at the hearing in order to challenge your application.
What factors will the Court consider when deciding whether to end my disqualification?
The Court that imposed the driving disqualification will look at several factors when considering your application for your licence to be reinstated, including:
- Your attitude and post conviction behaviour.
- The nature of the original offence.
- Any other circumstances regarding the case.
Can I apply for early removal of disqualification if I was disqualified for dangerous driving?
If you have been disqualified for dangerous driving, you will have to pass an extended driving test before the disqualification is lifted. If the Court approves your application, you will be permitted to take the extended driving test early.
