Indefinite Leave to Remain

Depending on the type of visa you have, after a certain period of time (normally five years), you can apply for Indefinite Leave to Remain (ILR) also known as settlement. This means you can live, work, and travel in and out of the UK free from immigration law restrictions. You must meet several eligibility conditions, including passing the Life in the UK test and meeting the English language and continuous residence requirements.

British Citizenship

For many migrants, obtaining British Citizenship is a dream come true. Unlike ILR, which you can lose if you are out of the country for two years or more, British citizenship is normally for life. Having British citizenship means you can vote in local and general elections and obtain a British Passport. You need to meet several requirements to become a British citizen, including holding ILR or Settled Status for 12 months minimum. You must also be of good character and have not broken any immigration rules during your time in the UK.

Right of Abode

Having a right of abode means you can live and work in the UK without any immigration restrictions. British citizens automatically have right of abode as do some Commonwealth citizens. For example, Commonwealth citizen may have a right of abode if one of their parents was born in the UK and a citizen of the United Kingdom and colonies when the applicant was born or adopted. In certain circumstances, you can obtain a right of abode through marriage; however, special conditions must be met and you will invariably require legal advice to make a successful application.

Stateless Person

If you are not recognised as a citizen of any country and are unable to live in any other country, you may be able to apply to live in the UK, even if you have been refused asylum.

EU Settlement Scheme

When the UK left the EU at 11pm on 31st December 2020, the right of freedom of movement also ended. EU citizens living in the UK who wanted to remain in Britain had to apply for settled status or pre-settled status under the EU Settlement Scheme. The deadline for most people to apply under the EU Settlement Scheme was 30 June 2021. However, some exceptions for late applications apply. An Immigration Law Solicitor can advise you as to whether you have grounds to make a late application.

If you have pre-settled status, you can normally apply for settled status if you have lived in the UK for five years.
