What is a right of abode?
If you have right of abode you can live and work in the UK without any immigration restrictions. All UK citizens have right of abode as well as some Commonwealth citizens.
How do Commonwealth citizens acquire right of abode?
There are two ways to get right of abode as a Commonwealth citizen:
a) Through your parents, or
b) Through marriage
You will have right of abode via your parents if:
One of your parents was born in the UK and a citizen of the United Kingdom and colonies when you were born or adopted, and
You were a Commonwealth citizen on 31 December 1982, and
You never stopped being a Commonwealth citizen (even temporarily) at any point after 31 December 1982.
Through marriage, a right of abode can be acquired for women if:
You have been married to someone with right of abode before 1 January 1983, and
You continued to be a Commonwealth citizen after 31 December 1982.
If your ex-husband has another living wife or widow who lives in the UK or has been in the UK at any time since her marriage (apart from certain exceptions) or has a certificate of entitlement to right of abode or permission to enter the UK because of her marriage, it is unlikely you will be granted a right of abode unless:
You entered the UK while married and before 1 August 1988, even if your husband has other wives in the UK, or
You have been in the UK since your marriage and at that time were your husband’s only wife to have legally entered the UK or been given permission to do so
What is a certificate of entitlement?
To prove you have a right of abode, you can purchase a certificate of entitlement that you can attach to your passport. You will not need this if you have applied for and have been granted a British passport.
