Sponsor Licence Downgrades, Suspensions and Revocation

With Hadi Law as your trusted Business Immigration Solicitors, we will make sure that your organisation understands and continues to meet its Sponsor Licence compliance obligations. Our objective is to protect your Sponsor Licence from ever being downgraded, suspended, or revoked. Unfortunately, if, during a compliance visit, UK Visas and Immigration (UKVI) spot even the smallest problem with your sponsorship management process, your ability to sponsor overseas workers may be at risk. Depending on the severity of the problem, you may initially lose the ability to sponsor new overseas workers, and in the case of revocation (i.e. cancellation) by the Home Office, your existing sponsored workers will have their visas cancelled early. At Hadi Law, our corporate immigration Solicitors provide honest, commercially astute, proactive Sponsor Licence support and guidance for businesses of all types and sizes throughout the UK.

“I recently used Hadi Law for an immigration matter. I would like to thank everyone at Hadi Law Solicitors for their excellent work, professionalism, kindness and understanding. Thank you for sorting my query out in such a quick and friendly manner.”

Hadi Law is dedicated to helping businesses to achieve their commercial ambitions. The UK’s current skill shortage means that businesses are increasingly reliant on their ability to hire talent from overseas to support their operations and expansion. This means that no sponsoring business can afford to have its Sponsor Licence downgraded, suspended, or revoked. If you find yourself at risk of losing your sponsor licence, we will take immediate action to review the problem and then help you to resolve the matter and demonstrate to UKVI that you are now fully compliant. Doing so will ensure your Sponsor Licence is upgraded or fully reinstated.

What happens when the Home Office suspends a sponsor licence?

Following a compliance visit, which will often be unannounced, if the Home Office has concerns about your Sponsor Licence compliance, it may send you a letter, normally by email, notifying you of the suspension of your licence until further investigations are concluded. In some cases, they may downgrade your Sponsor Licence to a B-rating, meaning that you will need to take steps to resolve the issues that have been identified.

If you receive notification that your Sponsor Licence is being suspended, you must contact us immediately. We will carefully consider the reasons the Home Office has given for the suspension and advise you on the course of action that is in your best interests. Our Business Immigration Solicitors will request a copy of the notes taken by the compliance officer during their compliance visit and assess whether you have any defence to the allegations, and if not, we will provide the Home Office with an explanation for the breaches and set out the action points you are taking to prevent them from happening again.

How will the revocation of my Sponsor Licence affect my business?

If your Sponsor Licence is revoked, not only will you not be able to recruit new talent from abroad, your current migrant workers will have their work visa curtailed (shortened), meaning they will need to return to their home country. Your business will also be barred from applying for another Sponsor Licence for at least one year.

There are certain circumstances that will result in a mandatory revocation of your licence. These include, but are not limited to:
