Exceptional Hardship

Exceptional hardship is an argument that if applicable, can be used in court to avoid a ‘totting up’ ban.

This is when other / third parties would suffer if you were to receive a driving ban. This could include family members, friends, colleagues or members of the community.

If you can show that exceptional hardship would occur if you were banned from driving, the court could be persuaded to reduce or not implement a driving ban completely.

Your defence team is only able to use this argument if this is applicable and if you are at risk of a 12 point totting up ban.

Examples of exceptional hardship

A ban could result in:

  • You may lose your job
  • You could lose your house
  • Your mobility could be restricted
  • Your health being damaged
  • Not being able to care for elderly or vulnerable family members
